Tax Rules for Holding a Lake Conroe Weekend House You Use Yourself
Updated October 2026
What federal tax rules apply when you buy a lake house on Lake Conroe for your own use?
As of October 2026, Internal Revenue Service rules let you treat a Lake Conroe house never held out for rent or resale as a qualified home.

When can a Lake Conroe weekend house count as a qualified home?
Publication 936 says a second home you never hold out for rent or resale to others during the year can be treated as a qualified home.
Tax Topic 505 says a second home can include any other residence you own and choose to treat as a second home. A house on Lake Conroe that you own can be that residence, by your own choice.
If you have a second home that you don’t hold out for rent or resale to others at any time during the year, you can treat it as a qualified home.
Is the mortgage interest on a Lake Conroe second home deductible?
The Internal Revenue Service's frequently asked questions on itemized deductions say mortgage interest on a second residence used personally is deductible. They attach a condition: the mortgage must satisfy the same requirements for deductible interest as a mortgage on a primary residence.
Tax Topic 505 counts interest paid on a loan secured by a main home or a second home as qualified mortgage interest. A loan secured by the Lake Conroe house itself fits the second-home half of that definition.
How is Lake Conroe mortgage debt counted against the federal limit?
For a home acquired after December 15, 2017, the Internal Revenue Service's itemized-deduction answers set the home acquisition debt limit at $750,000, or $375,000 if married filing separately.
Publication 936 adds that the dollar limits for its second and third categories of debt apply to the combined mortgages on your main home and second home. Under that rule, the loan on a Lake Conroe house and the loan on your main home are counted together against those category limits.
How do Lake Conroe property taxes fit the federal deduction?
State and local real property taxes are generally deductible, the Internal Revenue Service's answers on itemized deductions say. Every Lake Conroe home pays Montgomery County, $0.3770 per $100 of value for 2025, and the county hospital district, $0.0473.
Each lot then adds one school district, plus a utility district, an emergency services district or a city where it sits in one. For 2025 the units HAR lists add up to $1.6155 per $100 in Grand Harbor and $1.7855 in Bentwater, before exemptions.
The same answers limit the total deduction for all state and local taxes to $40,000, or $20,000 if married filing separately. Real property, personal property and income or sales taxes all count toward that one cap, so the lake house's tax and the main home's tax share it.
The total deduction allowed for all state and local taxes (for example, real property taxes, personal property taxes, and income taxes or sales taxes) is limited to $40,000; or $20,000 if married filing separately.
Questions & answers
Lake Conroe questions, answered
Do I have to spend time at my Lake Conroe lake house to treat it as a second home for taxes?
No. In Publication 936, the Internal Revenue Service says you don't have to use the home during the year, and Tax Topic 505 says the same. Publication 936 keeps one requirement in place: at no point in the year may the house be offered to others for rent or resale. A Lake Conroe house that stays empty through a season can still be treated as a qualified home while that requirement holds.
Tax Topic 505 frames a second home as a residence you own and elect to treat that way. The same rule covers a lake house used every weekend, used only on holidays, or left closed for a whole year.
Can I deduct the points on my Lake Conroe lake house loan in the year I close?
Not all at once. Tax Topic 505 includes points you pay on a loan secured by a second home in qualified mortgage interest. In Publication 936, the Internal Revenue Service limits the timing: points paid on loans secured by your second home can't be fully deducted in the year you pay them. You deduct them only over the life of the loan.
That spreads the points across each year the lake-house loan runs. The interest itself still has to meet the requirements that apply to a primary-residence mortgage, according to the Internal Revenue Service's frequently asked questions on itemized deductions.
If I sell my Lake Conroe lake house, can I still deduct the mortgage interest for that year?
Yes, up to a point. In Publication 936, the Internal Revenue Service says a seller can deduct home mortgage interest paid up to, but not including, the date of the sale. That deduction stays subject to any limits that apply. One is the debt limit for homes acquired after December 15, 2017, set out in the agency's answers on itemized deductions.
Interest paid on the closing date or after it sits outside that rule. For a lake house sold partway through a year, the year's interest deduction runs through the day before closing.
When a Lake Conroe house changes hands mid-year, who is treated as paying the property tax?
In Publication 530, the Internal Revenue Service treats the seller as paying the property taxes up to but not including the date of sale, for federal income tax purposes. On the lake those taxes include Montgomery County, its hospital district and a school district. A utility district, an emergency services district or a city is added where the lot lies in one.
Montgomery County approved $0.3860 per $100 of value for 2026 on September 8, 2026. Montgomery ISD, Conroe ISD and Willis ISD all adopted lower rates in August. The parcel's account at the Montgomery Central Appraisal District lists every unit that taxes a given lot.
Are Bentwater or Walden association dues deductible on a lake house I use myself?
No. In Publication 530, the Internal Revenue Service says homeowners' association assessments can't be deducted, because the association, rather than a state or local government, imposes them. Bentwater's property owners association charges $996 a year plus $150 to its street repair fund. Walden's community association set its 2026 maintenance fee at $1,150. Both are charges an association imposes.
Bentwater's association also collects a $500 transfer fee and a $597.60 capital reserve fee at closing when a home sells. Some Walden sections add a section fee on top of the maintenance fee. Bentwater's club bills separately from its association.
Can I deduct the homeowner's insurance on my Lake Conroe weekend house?
No. In Publication 530, the Internal Revenue Service lists fire or homeowner's insurance premiums among the nondeductible expenses that may be part of a house payment. The same list names mortgage insurance premiums and the amount applied to reduce the principal of the mortgage. A homeowner's premium on a lake house is a cost to budget for, with no federal deduction under that list.
Away from the coast, the Texas Department of Insurance says, a homeowners policy probably includes wind and hail, sometimes with a separate windstorm deductible. Montgomery County is outside the Texas Windstorm Insurance Association's area. Flood cover is a separate policy, since most home policies leave flood out.
