Updated October 2026

In October 2026, an heir sells once a court validates the will or another Texas route clears title, and a sale above the heir's basis is a taxable gain.

How does a will get an inherited Lake Conroe house to a sale?
Under the Texas State Law Library's probate guide, a will can't be used to prove property transfer until it is validated by the courts. The guide places the governing law primarily in the Texas Estates Code.
If the court appoints an executor or administrator at the same hearing, the guide says that person can begin the administration process. Estate administration requires an attorney, the same guide notes.
The appointment comes with its own paper. In the guide's terms, an executor's letters are called letters testamentary, and an administrator's are letters of administration.
Do heirs pay tax when they sell an inherited Lake Conroe house?
Whether a sale is taxable turns on basis. The IRS answer on selling inherited property says you must first determine your basis in the property.
Basis in an inheritance follows its own rule. IRS Publication 551 says you can't determine your basis in some assets by cost, and that this includes property received as an inheritance.
If you sell the property for more than your basis, you have a taxable gain, the IRS answer says. The same answer counts the gross proceeds from the sale in gross income when considering the need to file.
Which Lake Conroe records should heirs have ready for a buyer?
Buyers of a Lake Conroe waterfront house ask about the paper that comes with the water. That starts with the San Jacinto River Authority's license for any dock, boathouse or lift, and the separate permit for the bulkhead.
They also want to know where the lot sits against the authority's flowage easement, and what the owners association and any club cost each year. Lake Conroe's normal pool is 201 feet above mean sea level, the authority reports. Its highest level, 206.24 feet, came on August 28, 2017.
Kim Vargas of Real Broker, LLC asks the seller for the license numbers and fee receipts before the option period ends. On an inherited house, that request goes to whoever signs for the estate or the heirs.

Questions & answers
Lake Conroe questions, answered
Can we sell an inherited Lake Conroe house without a full estate administration?
Sometimes. The Texas State Law Library's probate guide lists muniment of title among its informal methods. It says muniment of title is commonly used when the only asset transferred by the will is real property. An estate whose will leaves the lake house and nothing else to transfer matches that description. Whether it suits your estate is a question to put to a Texas probate attorney before you list.
The guide's wording is about common use. It names the situation where muniment of title usually appears and sets no rule that every such estate must use it. Muniment of title starts from a will, so have the original will in hand first. For a waterfront house, keep the deed, the survey and the river authority's license numbers in the same folder. Whichever route the attorney recommends, a buyer will still ask for that lake paper.
How do we prove who the heirs are before selling a Lake Conroe house?
Through a determination of heirship, which the Texas State Law Library describes as a legal proceeding to determine the heirs and their share of inheritance. Where several relatives each hold part of a Lake Conroe house, that proceeding answers who they are and how much each one holds. Ask a Texas probate attorney whether the estate needs one before you sign a listing agreement.
Each heir the proceeding names holds a share of the house. Gather every heir's contact details and preferred way to sign in one file before a buyer's option period starts. The same guide lists other informal routes beside heirship determinations, including affidavits of heirship and family settlement agreements. The attorney can say which one fits the estate.
Will a buyer accept an affidavit of heirship on an inherited Lake Conroe house?
Often, with some risk on the buyer's side. The Texas State Law Library's probate guide says real estate buyers and title companies commonly accept affidavits of heirship as proof of title, but it does involve some risks to the buyer. Ask the title company early whether it will accept one for your sale, before the house is under contract.
On a lake house, the buyer's side reads more than the title. Expect requests for the river authority's dock license numbers, the bulkhead permit and the yearly fee receipts during the option period. Keeping the affidavit, the survey and that lake paper together lets a buyer weigh the title question beside everything else about the lot.
Can the heirs handle the Lake Conroe house differently from what the will says?
Yes, if every party agrees. The Texas State Law Library's probate guide says family settlement agreements are enforceable just like any other contract. It adds that they may differ from what's stated in the will as long as all the parties agree. Several heirs can use one to set terms for the lake house that the will does not.
The condition carries the weight. Without every party's agreement, the guide's condition is not met. Have a Texas probate attorney prepare the agreement. Settle it before you sign a listing agreement, so the price and the people who will sign are agreed first.
Where do heirs get the value of the Lake Conroe house on the date of death?
From the executor. The IRS answer on selling inherited property says that for information on the FMV of inherited property on the date of the decedent's death, you contact the executor of the decedent's estate. FMV means fair market value. Ask for the figure in writing, with how it was reached, and keep it with the papers for the year of the sale.
Consistency matters for some estates. IRS Publication 551 says section 1014(f) requires that basis of certain property acquired from a decedent be consistent with the value of the property as finally determined for estate tax purposes. That rule reaches certain property, not every inheritance. Ask your tax adviser whether it applies to the house before you report the sale.
Does fixing up the inherited Lake Conroe house before the sale change the tax?
It can. IRS Publication 551 says that if you make improvements to the property, increase your basis. A higher basis narrows the distance between basis and sale price, and the IRS answer on inherited property treats a sale above basis as a taxable gain. Keep receipts for every improvement the heirs pay for, since basis is the starting point.
Work on the water has its own rules at Lake Conroe. The San Jacinto River Authority's rules make it a violation to install, replace or change a bulkhead without its permit, separate from any dock license. A dock, boathouse or lift needs the authority's residential license, and the authority can require an unpermitted structure removed at the owner's cost. Keep each permit beside the improvement receipts in the estate's file.
